A. Holding Fee
1. The Buyer understands that once a holding fee is received to hold a puppy, it is the same as signing this contract in person.
2. At no time will a holding fee be refunded for change of buyer's mind. Should a buyer have a change of mind the seller may have lost a future sale of said puppy. Please make sure you are ready for a puppy as change of mind is not a refundable option.
3. A holding fee is only refundable if the puppy should die while in the breeder's care or a health issue should arise making the puppy unsuitable for sale.
4. Once the holding fee is received it locks the puppy in as sold for the buyer and takes the puppy off the sellers' market.
B. Health Guarantee
1. The breeder certifies that this puppy has been thoroughly examined by a licensed veterinarian and is in good health. The results of the exam will be given to the purchaser, also indicating what vaccinations and dewormings for his age. All further vaccinations, follow-ups, and dewormings will become the sole responsibility of the purchaser.
2. The breeder guarantees the puppy against PARVOVIRUS, DISTEMPER, RABIES for a period on NO MORE than 10 days. No other infectious diseases or viruses are covered under this agreement and the purchaser accepts this by signing this agreement.
3. The Guarantee does not cover Parasites internal or external, coccidiosis, Giardia, hypoglycemia, hepatitis. We do not refund or replace for hernias of any type, as they can and do appear as a dog grows.
i. Some parasites can develop within a few hours or days, such as Coccidiosis, which is a parasite related to stress and has nothing to do with bad or good breeding. Therefore, all puppies going to new homes should have a stool sample analyzed by the purchaser's veterinarian to make sure the puppy has not developed any such problem. If such a problem should occur, the purchaser takes full responsibility to care for the puppy and will not hold the breeder accountable in any way. The breeder has administered only the basic deworming product recommended by the breeder's veterinarian and cannot be held accountable for a problem arising after the puppy is delivered to the purchaser.
4. The breeder hereby guarantees the puppy for LIFE against life threatening genetic defects. If such a defect is found by the buyer's veterinarian, they must contact the breeder immediately. The buyer must also give the breeder the vet report and vet contact information so they can talk to the vet. The breeder may want a 2nd opinion and has the right to get one at their request. If a life-threatening genetic defect is found, the breeder will either offer the buyer a replacement puppy or their money back of the purchase price of the puppy.
5. The breeder cannot take any other responsibility for the puppy once it is no longer under the breeder's care and therefore cannot control which animals the puppy may come into contact with and from which the puppy may then be infected. We do not cover hydrocephalus in any dog over the age of 6 months. Therefore, it is recommended that the purchaser not allow the puppy to come into direct contact with any other animals for a period of at least 15 days and to have his/her veterinarian check the puppy thoroughly to attest to his good health.
6. The Breeder guarantees the above-described puppy or dog will be free of life threatening congenital defects for their entire life.
i. If any abnormality should be found by the purchaser's veterinarian, that could seriously endanger the life and health of the puppy, the purchaser must advise the breeder IMMEDIATELY of the problem. If the purchaser does not advise the breeder of such problem IMMEDIATELY, then the purchaser will have no recourse against the breeder and the purchaser accepts this.
ii. The purchaser, however, if returning a puppy that has been diagnosed with a serious, life threatening health problem, the purchaser must take full responsibility in bringing the puppy back to the breeder. The breeder would then offer an exchange for the puppy when a puppy similar to the purchaser's puppy becomes available or will refund the purchase price of the puppy, whichever the purchaser chooses. Under all other circumstances it is understood that no exchange or refund will take place. The breeder may take from 12 to 24 months to have another puppy available for the purchaser, and the purchaser accepts this.
iii. This guarantee DOES NOT cover the following minor flaws or any condition that is minor and can be corrected by veterinarian intervention.
a. OPEN FONTANEL
b. UNEVEN BITE (This is not a health-related problem)
c. COAT TYPE/COLOR (Coat color and type can change as the puppy matures)
d. SIZE (We give no guarantee concerning the size a puppy will mature)
e. HERNIAS (Of any category)
7. If at any time after delivery of the puppy to the purchaser, the puppy requires hospitalization due to HYPOGLYCEMIA (low blood sugar) symptoms, the breeder WILL NOT BE held accountable. The breeder will not be held responsible for any of the many causes of low blood sugar, as they vary and include but are not limited to: stress, shipping, not eating properly, etc. If any of these symptoms occurs, the purchaser must advise his veterinarian as time is of the essence.
i. It is the responsibility of the purchaser to assure proper care if such condition should arise and the purchaser agrees NOT TO HOLD THE BREEDER ACCOUNTABLE AT ANY TIME should hypoglycemia symptoms occur, and the purchaser requires the services of a veterinarian to care for the sick puppy.
8. This guarantee does not cover injuries caused by a fall or because the puppy was physically harmed in any way. In light of this, it is recommended to never leave the puppy without proper care or supervision or left alone on a couch, table, or bed, and the breeder recommends taking extra care when closing doors, especially patio doors.
9. This guarantee does not cover cerebral injuries due to any circumstance.
10. If a puppy is spayed/neutered before 12 months of age, the health guarantee becomes null and void.
11. Any other infections, except those stated in the guarantee agreement, WILL NOT BE the responsibility of the breeder and the purchaser agrees to this.

C. Veterinary Care
1. The breeder recommends to the purchaser to seek the services of a veterinarian that is knowledgeable about this breed in order to avoid any serious problems.
2. The breeder WILL NOT BE HELD accountable for adverse reactions that may occur because of vaccinations or medication given such as flea/tick/heartworm preventatives administered by the purchaser's veterinarian.
3. The breeder gives the purchaser a period of NO MORE than 3 working days after taking possession of the puppy to have the puppy thoroughly checked by their own veterinarian.
4. The purchaser agrees that they are completely responsible for any and all vet bills should they arise and will not hold the seller responsible for them for any reason after taking the puppy home. Even should the puppy pass away or need to be returned to the seller.
D. Socialization and Exercise
1. Socialization and exercise are essential for a puppy's health and well-being. A well socialized dog is a happy dog and leads to a happy owner.
2. Start socializing your puppy from day one. Socialize him/her with adults and children, dogs and other animals, noises and situations that the dog may encounter throughout its life.
3. Exercise is a daily requirement in your dog's health. Walks are good as they not only allow your dog the exercise it needs but also gives you bonding time.
E. Hypoallergenic Provisions
1. This contract does not cover allergies that the purchaser or other family members may develop to the dog.
2. If purchasing a doodle of any sort, the breeder does not guarantee that it will be either hypoallergenic or non- shedding. These puppies do have Golden Retriever in them and some puppies will shed some and some will not be hypoallergenic due to the genetics of the Golden Retriever.
F. Limited Registration - No Breeding Rights
1. If a male is purchaser as PET ONLY, WITHOUT BREEDING RIGHTS, the breeder does not guarantee the presence of both testicles. If only 1 testicle or no testicles are descended or present, the breeder will not be held accountable and the purchaser accepts this by signing this guarantee agreement understanding that no exchange or refund will be considered.
2. If in the event the puppy develops patella luxation; to short or to long ligaments in the paw, feet, or leg area; or hip displasia, the breeder will not be held accountable and the purchaser takes full responsibility if such a case should arise to have the puppy treated at his/her own expense. Unless it is stated in writing by 2 veterinarians that the luxation/dysplasia was not caused by an injury or roughness, and that in their opinion it was genetic, and qualifies in severity (*See attached health guarantee for severity qualifications) there will be no refund. If papers from 2 veterinarians stating that in their opinion the luxation/dysplasia is genetic are received, and of the qualifying severity, the seller will either replace the puppy or refund the purchase price of the puppy. All vet expenses are the responsibility of the purchaser.
3. When a puppy is sold at a reduced price, or with "limited" registration, the buyer understands that by reducing the price you (the Buyer) have waived your right to having breeding rights. Registration is only included with a full price puppy and/or one with full AKC registration.
i. Pet only/limited registration dogs are not to be bred or used for breeding. At no time are registration papers to be issued to pet only buyers without the breeder receiving full purchase price compensation and written permission from the breeder.
G. Showing
1. WE DO NOT guarantee a dog for show unless it is over 6 months old and we have shown it at an AKC sanctioned event ourselves. Puppies that are show quality at the time of purchase can and do fall apart conformation wise.
H. Defamation of Character
1. The Buyer and Seller agree not to put anything negative about each other using social media or any other outlets (newspapers, etc.).
I. Terms of Contract
1. If a dispute concerning this sale should arise, all legal matters must be filed and take place in the county of Washington, State of Kansas.
2. After having read, understood, and accepted all aspects of this contract, the purchaser has agreed to the above terms by signing or placing a deposit as previously stated.
3. All of the above terms go into effect as soon as the deposit is received.
4. Even if this contract is not signed, by purchasing a puppy from Golden B Acres (David and/or Crystal Bowser), you are agreeing to all the contract terms and they apply the same as signing once the Buyer has possession of the puppy.
5. This contract is NOT transferrable to anyone and will apply only to the buyer(s) signed below.
J. Amendments
1. Any amendments to this contract must be in writing and signed by both parties.
